We recommend that you read these terms and conditions carefully. By using our website, creating an account or making a donation, you agree to these terms and conditions.
This website is operated by Stichting INFAK, a foundation established in the Netherlands and registered with the Dutch Chamber of Commerce (KvK) under number 97212482. Stichting INFAK supports people in need with food, water, education and emergency aid, anywhere in the world. Our contact details: • Email: info@stichtinginfak.nl • Website: www.stichtinginfak.nl • KvK number: 97212482 In these terms and conditions, the following definitions apply: • Foundation: Stichting INFAK, as described above, also referred to as "we" or "us". • Website: the website www.stichtinginfak.nl, including all associated pages and functionalities. • User: any natural person or legal entity who visits or uses the website, also referred to as "you". • Donor: any user who makes a donation to the foundation through the website. • Donation: a voluntary gift of a sum of money to the foundation, whether or not linked to a specific donation project. • Account: the personal user account that a user can register on the website. • Terms and conditions: these terms and conditions.
These terms and conditions apply to every visit to and every use of the website, to the creation and use of an account, and to every donation made through the website. By using the website, creating an account or making a donation, you declare that you have taken note of these terms and conditions and agree to them. If you do not agree to these terms and conditions, we ask that you do not use the website and do not make a donation. In addition, our privacy policy applies to the processing of your personal data, and our cookie policy applies to the use of cookies. Both documents are available on the website. If any provision of these terms and conditions is void or annulled, the remaining provisions will remain in full force. In that case, the void or annulled provision will be replaced by a valid provision that reflects the intent of the original provision as closely as possible.
Through the website, we inform you about our mission, our donation projects and our activities. The website also offers the opportunity to donate to the foundation's donation projects, to contact us via the contact form and to create an account with which you can track your donations and the projects you support. The information on the website is for informational purposes only. No rights can be derived from the content of the website, unless expressly stated otherwise. The information on the website does not constitute advice of any kind.
A donation made through the website is a voluntary gift to the foundation. By donating, you do not enter into any membership, subscription or other ongoing obligation, unless expressly stated otherwise. To be able to donate, you must be 18 years of age or older. You confirm this during the donation process. When you donate, the foundation asks for your full name, your email address, the donation amount and, optionally, your telephone number. Payments are processed through the external payment service providers Mollie and Stripe. Payment takes place in the secure payment environment of these providers; their own terms may additionally apply to that payment environment. The foundation itself does not receive or store any full payment details, such as card numbers. A donation is a gift and is final once the payment has been completed. There is no statutory right of withdrawal for completed gifts. If you have demonstrably made a mistake, for example by entering an incorrect amount or donating twice, please contact us as soon as possible, and no later than within 14 days of the donation, at info@stichtinginfak.nl. We will assess your request reasonably; any refund is made solely at the foundation's discretion and does not entitle you to any interest or reimbursement of costs. The foundation reserves the right to refuse or refund a donation without stating reasons, for example where fraud, misuse or a conflict with laws and regulations is suspected.
Donations benefit the foundation's objective: supporting people in need with food, water, education and emergency aid, anywhere in the world. When you donate to a specific donation project, we will make every effort to spend your donation on that project. This constitutes an obligation to use best efforts (an obligation of means) and not an obligation to achieve a specific result. If a project has been completed, is oversubscribed or proves, for whatever reason, not to be feasible or not fully feasible, the foundation is entitled to use the donated amount at its own discretion for comparable projects or wherever help is most urgently needed at that time, always within the foundation's objective. In that case, you are not entitled to a refund. The foundation may deduct reasonable costs from donations for the organisation, such as transaction costs, administrative costs and the costs of maintaining the website and providing aid.
You can register an account on the website using your email address and a password. Upon registration, we verify your email address. To secure your account, the website offers two-factor authentication (2FA) and the option of password recovery. With an account, you can, among other things, track your donations and the projects you support. When creating and using an account, the following obligations apply: • You provide accurate, complete and current information and keep this information up to date. • You keep your login details strictly confidential and do not share them with others. • You are responsible for all use made of your account, including by third parties to whom you have granted access or who have gained access through your actions. • If you suspect misuse of your account or the loss of your login details, you must report this as soon as possible at info@stichtinginfak.nl. The foundation is entitled to temporarily suspend or permanently delete an account in the event of (suspected) misuse, fraud, the provision of inaccurate information or a breach of these terms and conditions, without being liable for any compensation as a result. Where reasonably possible, we will inform you of the reason for the suspension or deletion.
You may use the website solely for the purposes for which it is intended and in accordance with these terms and conditions and applicable laws and regulations. In any event, it is not permitted to: • use the website in a manner that is harmful, unlawful or misleading to the foundation, other users or third parties; • circumvent, test or breach the security of the website, or gain unauthorised access to systems, accounts or data; • distribute viruses, malware or other harmful software via the website; • submit unlawful, offensive or otherwise harmful content via forms or other functionalities; • automatically copy, collect or reuse content from the website, for example by means of scraping, crawling or similar techniques, except to the extent permitted by mandatory law; • disrupt or place a disproportionate burden on the operation of the website. In the event of a breach of these provisions, the foundation is entitled to deny you access to the website or your account with immediate effect and to file a report or take other legal measures. Any damage suffered by the foundation as a result of the breach may be recovered from you.
All intellectual property rights in the website and the content placed on it, including texts, logos, corporate identity, photographs, videos, graphic design and software, belong exclusively to Stichting INFAK or its licensors. Nothing in these terms and conditions constitutes a transfer of these rights. It is not permitted to reproduce, publish, edit or otherwise use content from the website without the prior written consent of the foundation, except to the extent permitted under mandatory law, such as quotation within the limits of copyright law. If you wish to use content from the website, for example to draw attention to our projects, please contact us in advance at info@stichtinginfak.nl.
The foundation compiles the information on the website with the greatest possible care. Nevertheless, the foundation cannot guarantee that the information on the website is accurate, complete and up to date at all times. The foundation may amend the information on the website at any time. To the extent permitted by law, the foundation is not liable for any direct or indirect damage arising from or in connection with: • the use of the website or the inability to use the website; • inaccuracies or incompleteness in the information on the website; • malfunctions, interruptions, security incidents or other technical defects of the website; • the use of your account by third parties; • third-party websites and services to which the website refers or which the website uses, including the payment environments of the external payment service providers Mollie and Stripe. To the extent that the foundation is nevertheless liable despite the foregoing, its liability is limited to the amount of the donation to which the damage relates, unless mandatory law precludes this limitation. These limitations of liability do not apply if the damage is the result of intent or wilful recklessness on the part of the foundation. Nothing in these terms and conditions limits or excludes any rights to which you are entitled as a consumer under mandatory law.
The foundation makes every effort to keep the website available, but does not guarantee that the website will function uninterrupted, securely and error-free at all times. The foundation is entitled to change the website and the functionalities offered on it, in whole or in part, at any time, to suspend it temporarily, for example for maintenance or security purposes, or to discontinue it permanently, without being liable to users or third parties as a result. The foundation is not obliged to fulfil any obligation if it is prevented from doing so as a result of force majeure, which also includes disruptions at hosting providers, payment service providers or other third parties on which the foundation depends.
The foundation may amend these terms and conditions from time to time, for example in connection with new website functionalities or changes to laws and regulations. The amended terms and conditions apply from the moment they are published on the website. The date of the most recent change is stated at the top of this page. We advise you to consult these terms and conditions regularly. By continuing to use the website after the publication of amended terms and conditions, you accept the amended terms and conditions. If you do not agree to a change, you must stop using the website.
These terms and conditions, the use of the website and all donations made through the website are governed exclusively by Dutch law. If you are a consumer residing in another country, this choice of law does not affect the protection afforded to you under the mandatory law of that country. If you have a question, complaint or dispute, please contact us first. We will make every effort to reach a reasonable solution together with you. Disputes that cannot be resolved by mutual agreement will be submitted to the competent Dutch court.
